Abstract


This research adopts an inductive and analytical approach to examine the unique narration of Ishaq ibn Mansur al-Kawsaj regarding the two Imams, Ahmad ibn Hanbal and Ishaq ibn Rahwayh -may Allah have mercy on them- who permitted the hastening pilgrim (al-muta‘ajjil) to stone the Jamarat on the first day of departure (yawm al-nafr al-awwal) after sunrise. Scholars have differed in their acceptance of this narration due to the ambiguities it contains, which required its collection, clarification, and analysis.


The first part presents Ibn Mansur’s report from Imam Ahmad -may Allah have mercy on him- regarding the permissibility of stoning the Jamarat after sunrise. It then compares this report with other transmitted narrations from the Imam that differ in ruling, highlighting Ibn Mansur’s unique position in this regard.


The second part discusses how Imam Ahmad’s followers interpreted this narration: some diverted it from its apparent meaning, applying it to the second day of departure, such as Qadi Abu Ya‘la and al-Zarkashi; others, such as Shams al-Din Ibn Muflih and al-Mardawi, adhered to its apparent meaning. This reveals methodological differences among the scholars in interpreting and applying the narration.


The third part examines Ibn Mansur’s narration from Ishaq ibn Rahwayh concerning the same issue, following his narration from Imam Ahmad. This helps complete the understanding of the report and uncovers its inherent ambiguities, indicating its problematic nature.


In conclusion, the research summarizes the ambiguities surrounding the narration, clarifies them, and applies the methodological principles used by Imam Ahmad’s followers in dealing with his narrations to reach a conclusion consistent with their scholarly framework
